Crysis 3 driver crash

If I try to run it from the startup menu it says "this application is not compatible with this operating system. Please update to W or WXP" which is completely odd If I try to launch it as an administrator from the 64 bit application I get a black screen as if it's about to start and then it just crashes to desktop . I have a high end system that running an older game like this should not task. My rig has an intel i9 @GHz, 32Gb RAM, Windows 10, and a NVIDA GeForce RTX Super Graphics card. My video driver is up to date, I'm using DirectX , I have already tried switching off Anti-Aliasing and Shadow Play/Sharing.

Crysis 3 is crashing after games with black screen and white box saying "DXGI ERROR DEVICE REMOVED". when i look at the nvidia balloon in the bottom right corner it says "Nvidia kernel driver has stopped working but has recovered successfully".. this has happened 3 times now.
